BY USING OUR SERVICE, YOU AGREE TO THESE TERMS AND CONDITIONS; IF YOU DO NOT AGREE; DO NOT USE THE SERVICE.
Please read these terms and conditions carefully before subscribing to the 0845 TRAFFIC service. By using the service you are agreeing to our terms. If you do not agree then please leave the site and do not use the service.
You must obtain our permission in writing if you wish to reproduce, distribute, modify, transmit, reuse, repost, use or copy anything from this site or the 0845 TRAFFIC service. In general, you may reproduce these pages for the purpose of browsing them, or providing hypertext links to them.
The data on the site is made available for personal and non-commercial use. Keepmoving at its sole discretion reserves the right to monitor usage of this site and withdraw access to any user or IP address that it believes to be in breach of this condition.
The traffic information service ("the Service") is provided by ITIS Holdings, Station House, Stamford New Road, Altrincham, Cheshire, WA14 1EP. You agree and understand that ITIS Holdings is responsible for providing the Service, and before using it you must accept these terms and conditions between you and ITIS Holdings, which may be varied or amended from time to time by ITIS Holdings.
Each registration is for one user only. You undertake to register for the Service by providing your mobile telephone and network provider.
Access to the Service. IN ORDER TO USE THE SERVICE YOU (1) MUST BE AT LEAST 16 YEARS OF AGE AND HAVE THE CONSENT OF THE SUBSCRIBER OF THE MOBILE SERVICE TO SIGN-UP FOR AND USE THE SERVICE ON THEIR BEHALF AND (2) AGREE ON BEHALF OF THE SUBSCRIBER AND YOURSELF TO BE BOUND BY THESE TERMS. You agree that each person who requests such Service is your agent with full authority to act on your behalf with respect to such Service. The contract is void where prohibited. In order to use the Service, you must also have a mobile communications subscription with a participating carrier or otherwise have access to a mobile communications network for which Company makes the Service available, and pay any service fees associated with any such access. In addition, you must provide all equipment and software necessary to connect to the Service, including, but not limited to, a mobile handset or other mobile access device that is in working order and suitable for use in connection with the Service. You are responsible for ensuring that your equipment and/or software do not disturb or interfere with Company's operations. Any equipment or software causing interference shall be immediately disconnected from the Service and Company shall have the right to immediately terminate this Agreement. If any upgrade in or to the Service requires changes in your equipment or software, you must effect these changes at your own expense. Unless explicitly stated otherwise, any new or additional features that augment or enhance the current Service, including the release of new products and services, shall be subject to the terms and conditions of this Agreement.
This is a subscription service. It will cost £2.50 per month which will be added to your mobile phone bill at the date and time you joined each subsequent month. All calls are charged at up to 3.95p/min for BT customers. Any variation on this will be dependant on the network provider used.
This charge will continue to be incurred until you call 0845 TRAFFIC and select option 4 to cancel the subscription or email info@keepmoving.co.uk to cancel the subscription (please include your mobile number in the email). ITIS Holdings reserve the right to withdraw the service without prior notice. Information contained within the text message is subject to our fair usage policy.
Customers must be 16+ and have bill payer's permission. Standard operator SMS/WAP/GPRS/UMTS charges apply.
You may cancel your use of the Service by:
(a) texting 'STOP' to 82344;
(b) calling 0845 TRAFFIC and selecting option 4;
(c) or emailing info@keepmoving.co.uk to cancel the subscription (please include your mobile number in the email).
You will still be entitled to use the service for the remainder of the month for which you have already paid.
Whilst ITIS Holdings reasonably endeavour to ensure that the information provided via this Service is timely and accurate, no liability can be accepted arising from inaccuracies, delays in transmission of messages or omissions. Copyright in the content of all information provided to you belongs to ITIS Holdings. All rights are reserved. No material may be recorded, stored in a retrieval system, reproduced or transmitted in any form or by any means without prior written permission of ITIS Holdings.
ITIS Holdings will not be liable to you if you are unable to access or use the Service due to the failure of any machine, system or transmission link, any period of essential maintenance, critical change, repairs, alteration to or failure of computer or communication systems, any industrial dispute or anything beyond our reasonable control or that of our agents or subcontractors.
We may at any time and without prior notice withdraw all or any part of the Service. We shall be under no liability to you whatsoever in the event that the Service or part thereof is withdrawn.
All claims in relation to the use of this Service including any information provided to you for any loss of profits, inconvenience, economic loss, loss of business and loss of goodwill (in all these cases whether direct or indirect) together with any claims for indirect or consequential loss or damage are excluded to the fullest extent permitted by law. Nothing in these terms and conditions shall exclude liability for death or personal injury caused by negligence. Your statutory rights are not affected.
This Agreement and the Service is between you and ITIS Holdings. You may not assign, transfer or otherwise deal with the same.
Using Your Personal Information
1. ITIS Holdings ('we') will use your personal information for the following purposes:
(a) identify you when you contact us;
(b) in relation to the Service in order to help identify your account.
(c) In relation to the Service help administer, and to contact you about improved administration of any accounts and services we may provide in the future; and
(d) to help to prevent and detect fraud or loss.
2. We may allow other people and organisations to use information we hold about you for the purpose of providing the Service or if we have been legitimately asked to provide information for legal or regulatory purposes or as part of legal proceedings or prospective legal proceedings. From time to time, these other people and organisations may be outside the European Economic Area in countries that do not have the same standards of protection for personal data as the UK.
3. We may monitor and record communications with you (including phone conversations and emails) for quality assurance and compliance.
4. Where you give us information on behalf of someone else, you confirm that you have provided them with the information set out in this document and that they have not objected to or withheld the uses of their personal information described in it.
The Service and this agreement is subject to the laws of England and Wales and in the case of a dispute the Courts of England and Wales shall have exclusive jurisdiction. If you live in Scotland the laws of Scotland shall apply and the Courts of Scotland shall have exclusive jurisdiction.
